Procedure

  • Charge memorandum with statement of imputations is served on the delinquent.
  • Written statement of defence is called for; on denial, an Inquiry Officer and Presenting Officer are appointed.
  • Delinquent may inspect documents, cross-examine witnesses and lead defence evidence.
  • Inquiry report goes to the Disciplinary Authority, who records findings and passes a speaking order.

Punishments

  • Minor: censure, withholding of promotion, recovery of loss, withholding of increment.
  • Major: reduction in rank, compulsory retirement, removal from service, dismissal from service.
  • Dismissal disqualifies from future government employment; removal does not.
  • Appeal generally lies within 45 days; revision and review powers exist with higher authorities.

Principles

  • Natural justice: no one shall be judge in his own cause; both sides must be heard.
  • Article 311 protects civil servants — no dismissal or reduction in rank without inquiry, subject to exceptions.
